Terms of use
Effective 28 October 2026
1. About these terms
These terms apply when you use Keyfacts, operated by Keyfacts AU (ABN 75 194 244 750) (“we”, “us”). By creating an account, buying searches, or buying a response pack or an address pass you agree to them. The terms in effect when you buy something apply to that purchase (section 11). Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law.
2. What the service is — and isn’t
We compare suburbs, asking prices and rents with published government statistics. For a New South Wales address, an address check shows what the NSW planning and hazard maps hold across the lot, or at the address point when no lot can be read (zoning, heritage, flood planning, bush fire prone land, acid sulfate soils, aircraft noise, easements, biodiversity, mine subsidence, landslide and riparian land, and the local plan’s building height, floor space ratio, minimum lot size and land reservation maps), and the NSW Department of Education’s public school intake zones at the address, with the lot from the NSW cadastre and what’s nearby. Its free preview reads the zone, flood planning, bush fire prone land and heritage the same way, and shows the public school intake zones at the address. Results are shown with their dates, sources and limitations. Reports are general information only. They are not financial, credit, legal or tax advice, not a valuation of any property, and not a recommendation to buy, sell, rent or borrow. An address check reads published maps: it is not a planning certificate, a survey or a title search. The free rent increase check compares a new rent with published bond figures and applies the regulators’ published rules to the dates you enter; it does not see your agreement and does not decide whether an increase is valid or excessive (that is for NCAT or QCAT to decide). Get advice from a licensed professional, and inspect a property and its contract, before you commit.
Keyfacts isn’t affiliated with, or endorsed by, any government agency, tenancy regulator or tribunal, including NSW Fair Trading, the Residential Tenancies Authority, NCAT and QCAT.
3. Your account
- You sign in with a one-time code sent to your email. Keep access to that email secure.
- One account per person. Creating extra accounts to obtain free searches is not allowed and those accounts may be closed.
- You can delete your account at any time from the account page (you’re asked to sign in again first if you last signed in more than 15 minutes ago). If a payment is still clearing, you can delete the account once the payment has cleared (usually within a few days). Unused searches end with it, and any checkout you haven’t finished is cancelled. If you’re owed a refund for unused searches (sections 7 and 11), email us before you delete your account and we’ll refund them first. If a payment still completes after your account is deleted, we refund it in full.
4. Searches and credits
- A new verified account receives 3 free searches (one per person; we may limit free searches to prevent abuse).
- One search is one area report, or one price check or asking rent check. From 25 October 2026 the address check is sold only as the address pass (below), not for searches; an address check already on your account still re-opens as before. Checking a rent increase is free and needs no account. An investor report uses 5 searches.
- You can re-open a report free while it’s kept on your account. For 7 days from when it was first delivered, you can also make these changes on the report itself free: an area report’s budget, property type or bedrooms; a price or asking rent check’s asking amount or bedrooms (and a rent increase’s current rent and notice date); an investor report’s price, rent, property type, bedrooms, costs or loan. An address check can be re-opened free but not adjusted; if a map service didn’t answer, you can ask for a fresh reading of the same property free in the same 7 days (at most once a minute). Each report can be changed up to 39 times. A different area or postcode is a new search, and a different address is checked with an address pass (section 5A).
- If a search fails to produce a report, it isn’t charged — every search it used is returned automatically.
- Search packs don’t expire. Reports are kept on your account for six years (see the privacy policy).
- Prices are in Australian dollars, and the price shown is the total you pay. We aren’t registered for GST, so no GST is charged. We don’t charge card surcharges.
5. The rent increase response pack
- The response pack costs $5 and is bought without an account. It is a reply letter for your agent or landlord, filled in from the figures and the rules shown in your check and your own choices (which you can edit before you send it), and a dated evidence PDF. In Queensland it also includes a request for written proof of when the rent last went up, except where the lessor is an exempt lessor (such as some community housing providers), which that rule doesn’t bind. It is general information and a template, not legal advice, and we never contact your agent or landlord.
- We send a private link to the email address you give at checkout. Anyone with the link can open the pack, so keep it private.
- For 30 days after you buy it, you can update the pack’s figures and dates for the same place, up to 39 times, and change your reply, free.
- If something is wrong with your pack, email us at support@keyfacts.au with its reference; your rights under the Australian Consumer Law are in section 6.
- If a payment for a pack is refunded in full, or disputed with your bank, the pack closes (it opens again if a dispute is decided in our favour).
5A. The address pass
- The address pass costs $15 for one New South Wales address or $29 for three, and is bought without an account. For each address it gives an address check: what the NSW Government’s planning and hazard maps and the local environmental plan’s maps show across the lot (at the address point when no lot can be read, which the report says), the NSW Department of Education’s school intake zones at the address, the lot from the NSW cadastre, nearby places, the postcode’s published sale and rent figures, questions to ask, and an email you can send to your agent or conveyancer. It is general information from public maps and data. It is not a valuation, a section 10.7 planning certificate, a building approval or inspection, or planning, legal or financial advice, and a map that shows nothing at an address doesn’t mean nothing applies there.
- We send a private link to the email address you give at checkout. Anyone with the link can open the pass and every address on it, so keep it private. If you check addresses for clients (section 9), use a separate pass for each client.
- You can check the pass’s addresses for 30 days after you buy it. The first is the address you chose when buying; an address is used only once its check has been completed, so a check the map services couldn’t complete can be tried again, or, while the pass has an address left, you can check another address instead. If one of the map services didn’t answer for an address, you can ask for a fresh reading of it free for 7 days from its first check (up to 3 times). The reports stay at the link after the 30 days (see the privacy policy).
- If something is wrong with your pass, email us at support@keyfacts.au with its reference; your rights under the Australian Consumer Law are in section 6.
- If a payment for a pass is refunded in full, or disputed with your bank, the pass closes (it opens again if a dispute is decided in our favour).
6. Refunds and your consumer rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
If a report, a pack or an address pass is faulty, or wasn’t delivered with due care and skill, email us at support@keyfacts.au with its reference. If a payment is refunded or reversed, the searches it bought are removed from your account.
7. Fair use
- Don’t scrape, copy in bulk, resell or republish reports or our data, or access the service with automated tools. This is about our service and our reports: the government datasets themselves stay available from their publishers under their own licences. Using reports for your own clients, as section 9 allows, is fine.
- Don’t try to get around search limits, payments or security.
- We may suspend an account while we look into a suspected breach of these rules, for no longer than we reasonably need to, and close it if the breach is serious or continues. We’ll tell you why where we reasonably can, and you can ask us to review the decision. If we close an account, or can’t restore access to it, we refund the searches bought with it that haven’t been used.
8. Data and accuracy
Figures are worked out from government open data (see data sources) and describe past periods. They can be revised, delayed or incomplete, and can’t reflect a particular property’s features. We show sample sizes and hide groups that are too small, and each figure is shown with its date and source.
9. Intellectual property
The service and its design belong to us. Government data is used under its licences (mostly Creative Commons Attribution 4.0) with the attributions shown on the data sources page; the publishers don’t endorse us or our reports. You may keep and share your own reports for personal use.
If you research properties for clients as part of your work, for example as a buyer’s agent, conveyancer or property adviser, you may also use searches, reports and address passes for that research and give each client the reports about their properties (on paper, by email or in a private client portal) as part of your own service to them. Passing on what you paid us as a cost of that work is fine. Keep each report’s dates, sources, limitations and copyright, attribution and licence notices with it, and don’t present it as your own work or as advice from us. Don’t sell reports, passes or access to them on their own, at a markup or to anyone who isn’t your client, or make them available to anyone but the client they’re for, such as on a public website or in a database or service open to others.
10. Liability
Nothing in these terms excludes, restricts or modifies the consumer guarantees or any other right you have under the Australian Consumer Law, or any liability the law doesn’t allow to be limited. Subject to that, we aren’t liable for loss that wasn’t reasonably foreseeable when you used or bought the service, or for delays or failures caused by events outside our reasonable control, such as an outage at a government data or map service.
11. Changes and general
We may change these terms for the future, for example when we add a feature or the law changes. The terms in effect when you buy searches, a pack or an address pass apply to that purchase, and a change won’t take away or reduce what you’ve already paid for. We’ll post a changed version here with its effective date, at least 30 days before a material change takes effect (a change that only benefits you, or that the law requires, can apply sooner). If you don’t agree to a change, email us before it takes effect: we’ll refund the searches you bought and haven’t used, and close your account. These terms are governed by the laws of New South Wales, Australia. Contact: support@keyfacts.au.
